RULES OF THE CIRCUIT COURT OF THE STATE OF NEW HAMPSHIRE -- DISTRICT DIVISION

CRIMINAL RULES

Rule 2.2. Bail and notice to defendant.

    
    A. Practice in Taking Bail. Every bail commissioner on taking bail shall make a record of the following facts: Date of taking bail, court date and time at which the prisoner is required to appear, the offense of which he is accused, the amount of bail, the names and residences of the principal and each surety. The bail commissioner shall forthwith deliver to the officer having the prisoner in charge a memorandum signed by such bail commissioner, containing the foregoing information. The record shall be made in triplicate and the original shall be given to the court, together with the bail, the second copy shall be given to the defendant, and the third copy shall be retained by the prosecuting agency.

(Editorial Note: The Administrative Committee of District and Municipal Courts has approved the use of more than three copies of the record, if a court wishes.)

   
B. Notice to Defendant. In every case where a warrant or summons is not issued and a defendant is released without bail and bail is not taken, the prosecution shall give a notice in hand to the defendant setting forth the date and time for the Court appearance. A copy of the notice shall be filed with the Court.

    C. Bail Forfeitures. Bail forfeitures shall be collected promptly by the Clerk of Court, including forfeitures where a professional bondsman is involved.

    D. No Attorney to be Bail. No attorney shall be bail or surety in any case pending before the Court.
