In Case No. 99-527, Thomas Morgenstern v. Town of Rye, the court on April 15, 2002, issued the following order:
The Town of Rye's motion for reconsideration and/or clarification is denied. The plaintiff's motion for partial reconsideration is granted. The slip opinion dated December 21, 2001, is withdrawn. A new opinion is being issued this date.
