In Case No. 2002-0210, Petition of Representative Peter Burling & a., the court on June 4, 2002, issued the following order:

On the motion of the Speaker of the House to modify and clarify the order of May 28, 2002, the request to modify paragraph 1 of the order to change the word "voters" to "people" is granted.

As the court has previously stated, its primary consideration in adopting a reapportionment plan is that it satisfy the federal and state constitutional principle of one person/one vote. The Speaker has requested that the court modify its order to state that plans be based on ward lines drawn as a result of the 2000 federal census, rather than on census blocks. The order is modified to permit, but not require, parties to submit plans based on ward lines drawn as a result of the 2000 federal census. The court expresses no opinion as to whether any such plan would satisfy the federal and state constitutional principle of one person/one vote, or whether the court would adopt such a plan. The parties may address these issues in their pleadings and at the time of oral argument.

With respect to the remaining constitutional issues, the parties may address them in their pleadings and at the time of oral argument.

The court will issue a further order regarding oral argument scheduled for June 11, 2002.
