RSA 504-A:13 requires the Court to establish a supervision fee for probationers which shall not be less than $40 per month unless waived by the Court. The fee may be any greater amount as established by the Court. This statute is interpreted to mean that the Sentencing Judge may set the appropriate supervision fee in every case in which an individual is sentenced to probation.

Accordingly, there is hereby established for the Superior Court a minimum monthly fee for supervision of probationers in the amount of $40. The Court may waive the fee or set a greater amount in any individual case.

As provided by the statute, this fee shall be considered a condition of release, and failure to satisfy the obligation shall be grounds for a violation hearing unless the probationer has been found to be indigent and therefore unable to pay the fee.
