In Case No. 2002-0210, Petition of Representative Peter Burling & a., the court on July 12, 2002, issued the following order:

RE: City of Concord

On July 1, 2002, the affidavit of Secretary of State, William M. Gardner, was filed with the court. In the affidavit, Secretary Gardner stated that several cities, including the City of Concord, changed their ward lines following the release of the 2000 census data. The affidavit of the Concord City Planner and certified copies of the city charter and the official map of the ward lines as revised after the 2000 census were also filed.

After reviewing the information filed by the city, we note a very slight discrepancy between the population of ward 1 as reported by the city and as reported in federal census data. The city reports that the population for ward 1 is 4189, whereas federal census figures indicate that the population is 4191. The court requests that parties and city officials review census tract 032700 Block 3017 to determine whether it was included in the population for ward 1 as determined by the city. Attached to this order is a map of the area in question. The boundaries on the paper copy of the map attached to this order are difficult to discern, but are easily discernable on the map when viewed in PDF format on the judicial branch web site (

On or before 12:00 noon on Tuesday, July 16, 2002, the parties and the city clerk shall advise the court whether census tract 032700 Block 3017 should be included in the population for ward 1, and shall provide any other information about the population discrepancy for ward 1.
